On 21 October 2024, the Disciplinary Tribunal found Mr Yunfei Yao breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a), in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d)(ii) of the Constitution as having “engaged in conduct which is derogatory to, or not in the best interests of, the Company or its Members” with respect to him engaging in academic misconduct during a Global Strategy & Leadership exam by using a mobile phone to take photographs of exam questions.
- Article 36(a), in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d)(ii) of the Constitution as having “engaged in conduct which is derogatory to, or not in the best interests of, the Company or its Members” during a Global Strategy & Leadership exam by using a mobile phone to communicate during that exam.
- Article 36(a), in that he had “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d)(ii) of the Constitution as having “engaged in conduct which is derogatory to, or not in the best interests of, the Company or its Members” by posting a question from the Global Strategy & Leadership exam on WeChat.
Mr Yunfei Yao did not attend the Disciplinary Tribunal hearing and a denial of the Complaint was entered on his behalf.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Complaint 1:
- Forfeiture of membership for a period of 3 years. Eligible for readmission upon the successful
completion of the Ethics and Governance Segment of the CPA Australia Program or a course
approved by the General Manager Professional Conduct. - A fail to be recorded against your examination - Global Strategy and Leadership.
Complaint 2:
- Forfeiture of membership for a period of 3 years.
Complaint 3:
- A fine of AUD$10,000.
- Forfeiture of membership for a period of 4 years.
Forfeiture referred to in Complaints 1, 2 and 3 is to be served concurrently.
The Member was ordered to pay CPA Australia’s costs of AUD$16,514.50.
