On 26 June 2024, the Disciplinary Tribunal found Ms Yao Ma breached CPA Australia’s Constitution of 11 May 2022:
- Article 36(a) in having “committed, participated in or been involved with an adverse event” as defined in Article 76(h) of the 11 May 2022 Constitution in that she “became the subject of a final adverse finding in relation to the member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction;” with respect to the sanctions imposed and published by the Public Company Accounting Oversight Board (PCAOB) on 30 November 2023 on the basis of its findings that she violated securities laws and/or PCAOB rules and standards in connection with the audits of 2015 - 2017 financial statements of Gridsum Holdings Inc. (“Company”).
Ms Ma admitted the Complaint prior to the convening of the Disciplinary Tribunal and consented to the Determination and imposition of the penalty below.
Penalty and Costs:
The One Person Tribunal imposed the following penalties:
Complaint 1:
- Suspension from membership for a period of two years commencing 30 November 2023.
- A Fine of AUD$1000.00.
Ms Ma was ordered to pay CPA Australia’s costs of AUD$4,253.70.
