On 18 April 2024, the One Person Tribunal found Mr Roy Spagnolo breached the 11 May 2022 Constitution (“the Constitution”) in that he breached:
- Article 36(a) by having “committed, participated in or been involved with an adverse event” as defined in Article 76(h) in that he “became the subject of a final adverse finding in relation to the member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction;” with respect to the finding of the Companies Auditors Disciplinary Board (CADB).
Mr Roy Spagnolo admitted the Complaint prior to the convening of the One Person Tribunal and consented to the Determination and imposition of the penalty below.
Penalty and Costs:
The One Person Tribunal imposed the following penalties:
Complaint 1:
- Forfeiture of membership, not eligible for readmission until 20 September 2024, in line with the CADB suspension timeframe.
- A Fine of $1,000.
The Member was ordered to pay a contribution to CPA Australia’s costs of $1,458.
