On 29 February 2024, the One Person Tribunal found Mr Gerardo Incollingo breached CPA Australia’s Constitution of 14 May 2019:

• Article 39(a)(ii)(F) when he was “the subject of a final adverse finding that has not been overturned on appeal in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction” with respect to a Tax Practitioners Board decision of 11 November 2021.

Mr Incollingo admitted the Complaint prior to the convening of the Disciplinary Tribunal and consented to the Determination and imposition of the penalty below.

Penalty and Costs:

The One Person Tribunal imposed the following penalties:

• a severe reprimand
• a Fine of $1000
• the member is to successfully complete a Practice Review by 31st December 2024 or as such time as directed by the General Manager Professional Conduct.

Mr Incollingo was ordered to pay a contribution to CPA Australia’s costs of $1,458.
