On 10 October 2024, the Disciplinary Tribunal found Mr Craig Baker breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a), when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d) of the Constitution, in that he “engaged in: (i) dishonourable practice in any profession or undertaking; or (ii) conduct which is derogatory to, or not in the best interests of, the Company or its Members” by using information obtained from his former employer and/or otherwise engaging in misleading or deceptive conduct to benefit himself or to cause detriment to his former employer.
- Article 36(a), when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(c) in that he “breached this Constitution (or a constitution of the Company in force from time to time before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations” by:
(a) failing to comply with R114.1(e) of APES 110 which requires that “A Member shall comply with the principle of confidentiality, which requires a Member to respect the confidentiality of information acquired as a result of professional and business relationships. A Member shall: …(e) Not use confidential information acquired as a result of professional and business relationships for the personal advantage of the Member or for the advantage of a third party” and/or
(b) failing to comply with R111.1 of APES 110 which requires that “A Member shall comply with the principle of integrity, which requires a Member to be straightforward and honest in all professional and business relationships” in that he used information obtained from his former employer and/or otherwise engaging in misleading or deceptive conduct to benefit himself and/or cause detriment to his former employer.
Mr Craig Baker attended the Disciplinary Tribunal hearing and denied the complaints.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following combined penalty:
- A severe reprimand
- A Fine of $1,000.00
- Mr Baker must complete a course in ethics titled “Professional Ethics” (119645047), or other course approved by the General Manager Professional Conduct within 6 months of 10 October 2024. A failure to complete the course to result in forfeiture of his membership.
The Member was ordered to pay CPA Australia’s costs of $14,006.50.
