On 16 October 2023, the Disciplinary Tribunal found Mr Zihao Zhou breached CPA Australia’s 11 May 2022 Constitution (“the Constitution”):
- Article 36(a) when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d)(i) as having “engaged in dishonourable practice in any profession or undertaking” with respect to you breaching the Academic Misconduct Policy.
- Article 36(a) when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d)(ii) as having “engaged in conduct which is derogatory to, or not in the best interests of the Company or its Members” by denying the publishing of CPA Australia exam related Material.
- Article 36(a) when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(d)(ii) of the Constitution, by having “engaged in conduct which is derogatory to, or not in the best interests of the Company or its Members” by breaching Undertakings concerning use of CPA Australia exam content material
Mr Zihao Zhou did not attend the Disciplinary Tribunal Hearing, a denial of the complaint was entered on his behalf.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Complaint 1:
- forfeiture of membership for three years
- a Fine of AU$5,000
- fail to be recorded for the Contemporary Business Issues examination.
Complaint 2:
- a severe reprimand
Complaint 3
- forfeiture of membership, not eligible for readmission
- a Fine of AU$10,000
- the General Manager Professional Conduct to advise the university at which the Member is currently enrolled of the determination of the tribunal
Member was ordered to pay a contribution to CPA Australia’s costs of AUD$2,320.
The Member appealed the decision of the Disciplinary Tribunal, which was heard on 24 April 2024.
