On 27 September 2023, the Disciplinary Tribunal found a Member of CPA Australia breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a) in that Member has “committed, participated in or been involved with an Adverse Event” as defined in Article 76(l) of the 11 May 2022 Constitution as having been “Closely Associated with a Practice Entity: (i) which has become Insolvent: (A) at the time when it became Insolvent; or (B) at any time during the two years prior to it becoming Insolvent” in relation to a Practicing Entity being Insolvent.
The Member attended the Disciplinary Tribunal and denied the Complaint.
Penalty and Costs:
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- A severe reprimand.
- The Member is to successfully complete a compliant CPA Australia Best Practice Program (Program), or its equivalent within twelve months or such time as allowed by the General Manager Professional Conduct. A failure to complete the Program within the prescribed timeframe, to result in forfeiture of membership. The Member is not eligible for admission until this requirement is met.
The Member was ordered to pay CPA Australia’s costs of AUD$3,059.20.
