On 4 December 2023, the Disciplinary Tribunal found Mr Kevin Broomhall breached CPA Australia’s 11 May 2022 Constitution:
- Article 36(a), when he “committed, participated in or been involved with an Adverse Event” as defined in Article 76(e) of the Constitution as having “failed to observe a proper standard of professional care skill or competence;” with respect to the lodgement of his client’s Personal Services Income forms with the ATO for the years ending 2016 to 2019 without the client’s signature or authority.
Mr Broomhall did not attend the Disciplinary Tribunal Hearing and a denial of the Complaint was entered on his behalf.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- A severe reprimand.
- Mr Broomhall must successfully complete:
- a Practice Review by 31st December 2024 or as such time as directed by the General Manager Professional Conduct (GMPC).
- the Ethics and Governance Segment of the CPA Program by 30 June 2025 or as such time as directed by the GMPC at his own cost.
- The GMPC to notify the Tax Practitioners Board of the outcome of this tribunal following the expiration of any appeal period or the determination of any unsuccessful appeal.
The Member was ordered to pay a contribution to CPA Australia’s costs of $2,820.
