On 19 May 2023 the Disciplinary Tribunal found Mr Hongyu Feng breached CPA Australia’s 14 May 2019 Constitution:

• Article 39(a)(ii)(C) in that he “failed to observe a proper standard of professional care, skill or competence”, by failing to document and communicate to the Client the Terms of Engagement.
• Article 39(a)(ii)(C) in that he “failed to observe a proper standard of professional care, skill or competence”, by withholding access to the Client’s Xero live records/accounting package (“File”).

Mr Hongyu Feng attended the Disciplinary Tribunal Hearing. Mr Feng admitted the first complaint and denied the second complaint.

Penalty and Costs:

The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:

Complaint 1:

• a severe reprimand

Complaint 2:

• a severe reprimand 
• a Fine of $1000.

The Member was ordered to pay a contribution to CPA Australia’s costs of $3,509.88.
