On 23 February 2022, the Disciplinary Tribunal found that Mr Paul Whyte breached CPA Australia’s 14 May 2019 Constitution:
- Article 39(a)(ii)(G) in that Mr Whyte “pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company” in relation to pleas of guilty to 562 charges of acting corruptly in the performance or discharge of functions as a Western Australian Public Officer to gain a benefit and two charges of property laundering before the Supreme Court of Western Australia.
- Article 39(a)(ii)(A) by failing to “provide a satisfactory explanation with respect to the matters referred to in the Complaint” to CPA Australia.
Penalty and Costs:
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
Complaint 1:
- forfeiture of membership, not to be readmitted
- a fine of $100,000.
Complaint 2:
- a severe reprimand.
Mr Whyte was ordered to pay a contribution to CPA Australia’s costs of $2,629.10.
