On 22 November 2022 the Disciplinary Tribunal found that Mr Chris Baldwin breached Article 39(a)(ii)(F) of the 14 May 2019 Constitution (“the Constitution”) in that Mr Baldwin had:
- “been the subject of an adverse finding that has not been overturned on appeal in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction”, in respect of a decision of the Australian Securities & Investments Commission dated 11 October 2021 that disqualified him as an approved Self-Managed Super Fund auditor from 15 October 2021.
Mr Baldwin attended the Disciplinary Tribunal Hearing and admitted the complaint.
Penalty and Costs:
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- Forfeiture of membership, not eligible for readmission for a period of 2 years.
The Disciplinary Tribunal also imposed the following conditions prior to any application for readmission:
- Mr Baldwin must successfully complete the Ethics and Governance Segment of the CPA Program or its equivalent to the satisfaction of the General Manager Professional Conduct (GMPC).
- Mr Baldwin must successfully complete a CPA Australia Best Practice Assessment to the satisfaction of the GMPC.
The Member was ordered to pay a contribution to CPA Australia’s costs in the amount of $2,809.66.
