"been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or regulatory authority in any jurisdiction" in respect of an order of the Federal Circuit Court of Australia dated 29 May 2020, in which the member was fined $11,000 for contraventions of the Fair Work Act 2009 (Cth) relating to the payment of pay pursuant to the Restaurant Industry Award 2010, maintenance of pay records and the provision of payslips with prescribed information to employees pursuant to the Fair Work Regulations 2009 (Cth).
Ms Ding attended the Disciplinary Tribunal and admitted the Complaint.
Penalty and Costs:
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- a severe reprimand
Ms Ding was ordered to pay CPA Australia’s costs of $2458.
