A hearing with respect to complaints concerning Ms Vittoria Anderson’s conduct was held on 18 November and 2 December 2020 by the Independent Investigator and Adjudicator (IIA) appointed by the Board under By-Law 5.12.
On 22 February 2021 the IIA found that Ms Vittoria Anderson breached the 14 May 2019 CPA Australia Constitution:
1. Article 39(a)(ii)(A) in that she ‘breached this Constitution (or the constitution of the Company in force immediately before the Amending Date), By-Laws, Code of Professional Conduct or the Applicable Regulations’ by:
(a) breaching APES 110 Subsection R115.1 where a member is to ‘avoid any conduct that the Member knows or should know might discredit the profession’ in that she forwarded a letter dated 17 April 2020 to CPA Australia’s Board without a resolution by the NSW Divisional Council to do so
(b) breaching APES 110 Subsection R113.1 (b) in that she did not ‘Act diligently and in accordance with applicable technical and professional standards’ by not signing the required Acknowledgment of the 2019 Handbook in her capacity as Divisional Councillor.
2. Article 39 (a)(ii)(B) 2) ‘conduct which is derogatory to, or not in the best interests of the Company or its Members’, by breaching APES 110 Subsections R115.1 and R113.1.
Ms Anderson attended the hearings with representation and denied the Complaints.
Penalty and costs
On 30 March 2021 a hearing with respect to penalty and costs was heard and the decision reserved.
On 26 May 2021, the IIA handed down his decision as to Penalty and Costs for the above breaches as follows:
1. (a) and 2:
- severe reprimand
- a fine of $5000.
1. (b) and 2:
- severe reprimand.
The Member was ordered to pay CPA Australia’s costs of $10,000.00, the payment of the costs and fine to be stayed for two months from the date of the delivery of the sanctions.
