On 30 November 2021 the Disciplinary Tribunal found the Mr Peter Caluzzi breached CPA Australia’s 14 May 2019 Constitution:
Volume 1:
- Article 39(a)(ii)(G), in that he had ‘pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company’ in respect of charges relating to drug trafficking and importing before the County Court of Victoria, in which he was sentenced in June 2021 to 17 years imprisonment.
- Article 39(a)(ii)(A), in that he breached By-Law 5.2(a)(ii) and/or 5.2(b)(ii) of the 1 January 2018 By-Laws, by failing to ‘provide a satisfactory explanation with respect to the matters referred to in the Complaint’ to CPA Australia.
Volume 2
- Article 39(a)(ii)(F), in that he had ‘been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction’ in respect of a decision of the Tax Practitioners Board dated 12 March 2020.
- Article 39(a)(ii)A, in that he breached By-Law 5.2(a)(ii) and/or 5.2(b)(ii) of the 29 May 2020 By-Laws, by failing to ‘provide a satisfactory explanation with respect to the matters referred to in the Complaint’ to CPA Australia.
Mr Caluzzi did not attend the Disciplinary Tribunal Hearing and a denial of the Complaints was entered on his behalf.
Penalty and Costs:
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
Volume 1
Complaint 1:
- forfeiture of membership, not ever eligible for readmission
Complaint 2:
- a severe reprimand
- a fine of $1000.
Volume 2
Complaint 1:
- forfeiture of membership for period of two years
Complaint 2:
- a severe reprimand
- a fine of $1000.
As the Complaints were sustained, Mr Caluzzi was ordered to pay a contribution to CPA Australia’s costs, in the amount of $2,858.33.
