On 25 June 2021 the Disciplinary Tribunal found the Member breached the 22 May 2018 Constitution:
- Article 39(a)(ii)(C), in that she “failed to observe a proper standard of professional care, skill or competence” by failing to obtain a trustee’s or public officer’s signed consent to the electronic lodgment of a trust tax return, for the financial year ending 30 June 2017; and failing to obtain the trustee’s or public officer’s declaration, as to the information upon which the tax return was based, as being true and correct, and by virtue of those failures failed to meet the requirements of the Australian Taxation Office.
Mrs Holzheimer attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- a severe reprimand
- successful completion of a Quality Review by 30 June 2022 or as directed by the General Manager Professional Conduct (GMPC) at the Member’s own cost
- successful completion of courses in the areas of “Privacy” and “Conflict of Interest” to the satisfaction of the GMPC within three months of the date of the Notice of the Decision.
The Member was ordered to pay CPA Australia’s costs of $2,573.88.
