- Article 39(a)(ii)(F) of the 14 May 2019 Constitution, as she has “been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction” in respect of a determination of the Tax Practitioners Board dated 5 December 2019 that suspended Ms Leung's registration as a Tax Agent for a period of six (6) months.
Ms Leung attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalty:
- forfeiture of membership for a period of six months.
The Disciplinary Tribunal also imposed the following condition:
- undertake the Public Practice Program eLearning within six months of readmission of membership or a similar program approved by the General Manager Professional Conduct.
As the Complaint was sustained, Ms Leung was ordered to pay CPA Australia's costs of $2478.75 AUD.
