On 30 November 2020, the Disciplinary Tribunal found the Member breached Article 39(a)(ii)(F) of the 22 May 2018 Constitution, in that the Member had “been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction”, in respect of an order of the Securities and Exchange Commission in the United States of America.

The Member did not attend the Disciplinary Tribunal Hearing; however, the Member was represented at the Hearing and the Complaint was denied.

Penalty and costs

The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:

• forfeiture of Membership, not eligible for readmission until 1 December 2025
• a fine of AU$10,000.

The Member was ordered to pay CPA Australia's costs of $2499.61.
