On 30 September 2020 the Disciplinary Tribunal found that a Member breached:
- Article 39(a)(ii)G of the Constitution in that he pleaded guilty to an offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company in respect of a conviction dated 1 November 2019, in which the member was sentenced to nine months good behaviour with a deposit of $2000 being payable in the event of a further offence and costs of $118.50 and a spent conviction order.
- Article 39(a)(ii)A in that he did not provide a satisfactory response within 10 business days as per By-Law 5.2(a)(ii).
The Member attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- Complaints 1:
- a severe reprimand
- lowering the Member's designation from FCPA to CPA for a period of five years commencing from 30 September 2020.
- Complaint 2:
- an admonishment.
The Disciplinary Tribunal took into consideration exceptional circumstances and decided to not publish the member's name or impose costs.
