- Article 39(a)(ii)(F) of the 14 May 2019 Constitution as he had “been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction” by virtue of a finding of the Schedule 2 Disciplinary Committee upon referral of the matter by the Australian Securities and Investment Commission (ASIC) on or about 25 November 2019 that imposed conditions on Mr Ball's registration as a liquidator.
Mr Ball attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalty:
- a severe reprimand
- fine of $5000
- Mr Ball must provide evidence of having completed CPA Australia's course ‘Making Ethical and Effective decisions’ to the General Manager Professional Conduct by 31 December 2020.
As the Complaint was sustained, Mr Ball was ordered to pay CPA Australia's costs of $2458.
