On 23 July 2020 the Disciplinary Tribunal found that Mr Jim Theodore Ulrich breached:

• Article 39(a)(ii)(C) of the 14 May 2019 Constitution (“the Constitution”) in that he “failed to observe a proper standard of professional care, skill or competence” by failing to obtain a client’s consent to the electronic lodgement of the client's income tax return for the financial years ending 30 June 2017 and 30 June 2018, and failing to obtain the Client's declarations as to the information upon which each of the tax returns were based as being true and correct.

Mr Ulrich attended the Disciplinary Tribunal hearing ad admitted the Complaint.

Penalty and costs

The Disciplinary Tribunal found the Complaint sustained and took into account mitigating circumstances in imposing the following penalties:

• admonishment
• complete a Quality Review at the next available cycle.

Mr Ulrich was ordered to pay CPA Australia's costs of $2458.
