On 16 June 2020 the Disciplinary Tribunal found that Mr Rajendram breached:
- Article 39(a)(ii)(G) of the 1 May 2012 Constitution (the Constitution), in that he “pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company” in that he was convicted by and pleaded guilty to the Courts of Law in Malaysia of offences under the Securities Industry Act 1983, Capital Markets & Services Act 2007 and the Penal Code and was sentenced to a period of imprisonment and was fined.
- Article 39(a)(ii)(F) of the 22 May 2018 Constitution (“the Constitution”) in that he had “been the subject of an adverse finding that has not been overturned on appeal in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction” in respect of a decision of the Disciplinary Committee of the Malaysian Institute of Accountants (MIA) on 26 February 2019 that ordered that his name be removed from the Register and that he cease to be a Member as a result of having been found guilty by a Court of Law in Malaysia.
Mr Rajendram did not attend the Disciplinary Tribunal Hearing and a denial of the Complaints were entered on his behalf.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties for each of the Complaints:
- forfeiture of Membership, not eligible for readmission for a period of 20 years
- a fine of $15,000.
Mr Rajendram was ordered to pay CPA Australia's costs of $2458.
