On 20 November 2019 the Disciplinary Tribunal found the Member breached Article 39(a)(ii)(F) of the 22 May 2018 Constitution (“the Constitution”) in that Mr Blackman had:
- “been the subject of an adverse finding that has not been overturned on appeal in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction” in respect of a decision of the Tax Practitioners Board dated 12 March 2019.
Mr Blackman attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
- The Disciplinary Tribunal found the Complaints sustained and imposed the following penalty:
- Forfeiture of Membership.
Prior to any application for readmission, Mr Blackman must first:
- Complete the Practice Management Program or its equivalent and obtain a Public Practice Certificate if in the opinion of the General Manager Professional Conduct (GMPC) he is providing Public Accounting Services
- Complete an ethics course to the satisfaction of the GMPC
- Provide evidence of having made all payments of any outstanding liabilities
The Member was ordered to pay CPA Australia’s costs of $2,550.14.
