On 26 November 2019 the Disciplinary Tribunal found the Member breached Article 39(a)(ii)(G) of the 14 May 2019 Constitution (“the Constitution”) in that Mr Chung had:
- "pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing and reputation of the Company” in respect of being found guilty in the Magistrates Court of the State Courts of Singapore on 10 August 2018 of a charge that he voluntarily caused hurt to a male person by slapping him once on the left cheek, causing him to suffer bodily pain and the conviction and sentence of the Offence was upheld on appeal by the High Court of the Republic of Singapore on 16 August 2019.
Mr Chung attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- a severe reprimand
- a fine in the amount of $4000 SGD
- a lowering of Membership status from FCPA to CPA for a period of five years effective from 26 November 2019.
The Member was ordered to pay CPA Australia’s costs of $2389.40 SGD.
