On 20 November 2019 the Disciplinary Tribunal found the member breached Article 39(a)(ii)(C) of the 14 May 2019 Constitution, in that he

1. “failed to observe a proper standard of professional care, skill or competence, by failing to obtain a client’s written consent to the electronic lodgement of her income tax return and failing to issue an engagement document to the client.”

The member attended the Disciplinary Tribunal Hearing in person and admitted the Complaint. 

Penalty and costs

The Disciplinary Tribunal sustained the Complaints and took into account mitigating circumstance in imposing the following penalties:

• admonishment
• completion of a Quality Review as advised by CPA Australia and to the satisfaction of the General Manager of Professional Conduct by 31 December 2020, a failure to comply will result in forfeiture of membership.

The member was ordered to pay CPA Australia’s costs of $2520.27.
