On 28 October 2019 the Disciplinary Tribunal found the member breached Article 39(a)(ii)(G) of the 22 May 2018 Constitution (“the Constitution”) in that Mr Read:
- “pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company” in respect of pleading guilty in the District Court of Western Australia at Perth (“Court”) on 21 February 2019 to twenty-five (25) charges of obtaining financial advantage from person/Commonwealth by deception in breach of section 134.2(1) Criminal Code Act 1995 (Cth) (“the Offences”).
- “pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company” in respect of pleading guilty in the District Court of Western Australia at Perth (“Court”) on 21 February 2019 to one (1) charge of attempt to obtain financial advantage from person/Commonwealth by deception in breach of section 134.2(1) and section 11.1(1) of the Criminal Code Act 1995 (Cth) (“the Offence”).
Mr Read did not attend the Disciplinary Tribunal Hearing.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- forfeiture of membership, not eligible for readmission for a period of 25 years
- a fine of $25,000.
Prior to any application for readmission, Mr Read must first pay the fine and costs and successfully complete the CPA Program or its equivalent at the time as a non-member.
The member was ordered to pay CPA Australia’s costs of $2537.59.
