On 12 March 2019 the Disciplinary Tribunal found Mr Oscar Altavilla breached:
- Article 39(a)(ii)(F) of the Constitution in that he has, ‘been the subject of an adverse finding that has not been overturned on appeal in relation to the Member’s conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction’ in respect of a Decision of the Australian Securities and Investment Commission (ASIC) dated 14 August 2018 which disqualified him from being an approved SMSF auditor under subsection 130F(2) of the Superannuation Industry (Supervision) Act 1993 (SIS Act) effective from 18 August 2018 (Decision).
Mr Altavilla did not attend the Disciplinary Tribunal Hearing and a denial of the Complaint was submitted on his behalf.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalty:
- forfeiture of Membership for two years
- prior to any application for readmission Mr Altavilla must successfully complete the Ethics and Governance segment of the CPA Program or its equivalent at the time at his own cost as a non-member.
Mr Altavilla was ordered to pay CPA Australia’s costs of $2615.26.
