On 13 December 2019, the Disciplinary Tribunal found the Member breached Article 39(a)(ii)(A) of the 22 May 2018 CPA Australia Constitution in that the Member breached:
- Section 100.5(d) of APES 110, which requires that “A Member shall comply with the following fundamental principles:…(d) Confidentiality - to respect the confidentiality of information acquired as a result of professional and business relationships, and therefore, not disclose any such information to third parties without proper and specific authority, unless there is a legal or professional right or duty to disclose, nor use the information for the personal advantage of the Member or third parties”
- Section 140.4 of APES 110, which requires that “A Member shall maintain confidentiality of information within the Firm or employing organisation”.
The Member attended the Disciplinary Tribunal in person and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- a severe reprimand
- undertake and complete a Privacy course approved by the General Manager Professional Conduct and completed by 31 March 2020.
The Member was ordered to pay CPA Australia’s costs of $1000.00.
