1. On 3 December 2019 the Disciplinary Tribunal found the member breached Article 39(a)(ii)(C) of the 14 May 2019 Constitution, in that he “failed to observe a proper standard of professional care, skill or competence in relation to his dealings with directors and associated entities.”

The member attended the Disciplinary Tribunal Hearing in person and admitted the Complaint. 

Penalty and costs

The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:

• admonishment
• the member must complete the Public Practice Program and obtain a Public Practice Certificate by 30 June 2020
• complete CPA Australia’s course Fundamentals of Business Law, or its equivalent, at a time line approved by the General Manager of Professional Conduct at the member’s cost.

The member was ordered to pay CPA Australia’s costs of $2555.03.
