On 27 April 2019 the Disciplinary Tribunal found Mr Bryan Cook breached the Constitution of 28 April 2014:
- Article 39(a)(ii)F, in that the member had been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction in respect of the Judgement of the Landgericht Stuttgart [Regional Court], 10th Large Commercial Criminal Court (Stuttgart Regional Court), in the name of People, Criminal matter against Bryan Leonard Cook and another, Reference No 10KLs 155 Js 97050/14, dated 24 June 2015, legally effective from 2 July 2015, issued 26 August 2015 (Judgement) which found Mr Cook guilty of deliberate market manipulation and sentenced him to imprisonment of 1 year and 9 months, which sentence was suspended, and required him to bear the costs of the proceedings.
- Article 39(a)(ii)G, in that the member pleaded guilty to, or been found guilty of (with or without conviction), any offence (criminal or otherwise, but excluding any offence relating to traffic infringement) before any Court in any jurisdiction (which, in the case of a finding or conviction has not been overturned on appeal) which in the reasonable opinion of the Board is likely to materially adversely reflect upon or affect the standing or reputation of the Company in respect of the Judgement which found Mr Cook guilty of deliberate market manipulation and sentenced him to imprisonment of 1 year and 9 months, which sentence was suspended, and required him to bear the costs of the proceedings.
The member attended the Disciplinary Tribunal Hearing in person and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the penalty of forfeiture of membership for a period of three years.
Prior to any application for readmission, the member must successfully complete the Ethics and Governance segment of the CPA Program or an equivalent approved course by the General Manager, Professional Conduct.
The member was ordered to pay CPA Australia’s costs of $4277.54.
