On 26 July 2018 the Disciplinary Tribunal found Mr Warna S Dayaranthe Jayalath Mudiyanselage breached Article 39(a)(ii)B.1) and Article 39(a)(ii)B.2) of the Constitution in that he was guilty of dishonourable practice in any profession or undertaking and conduct which is derogatory or not in the best interests of the Company or its Members.

The Disciplinary Tribunal found Mr Dayaranthe submitted a false Test Report Form to CPA Australia purportedly from IELTS as part of his application for Skilled Migration Assessment, showing he had successful scores across four areas of English proficiency skills, which scores he did not have.

Mr Dayaranthe attended the Disciplinary Tribunal Hearing and denied the Complaints.

Penalty and costs

The Disciplinary Tribunal found the Complaints sustained and imposed the following penalty:

• forfeiture of Membership
• Mr Dayaranthe is not eligible for readmission to Membership for three years
• prior to any application for readmission, Mr Dayaranthe must first satisfy the CPA Migration Team entry requirements or any other CPA Australia entry requirements at the time.

Mr Dayaranthe was ordered to pay CPA Australia’s costs of $756.64.
