On 27 November 2018 the Disciplinary Tribunal found Mr Lim Pang Yan breached Article 39(a)(iii)F of the Constitution in that he has, ‘been the subject of an adverse finding that has not been overturned on appeal in relation to the Member’s conduct, competence or recognition by a Court, professional body, statutory or other regulatory authority in any jurisdiction’ in respect of a Decision of the Disciplinary Committee of the Malaysian Institute of Accountants on 12 January 2018, which found Mr Lim:
- as Executive Director of Halex Holding Berhad (the “Company”) and the person primarily responsible for the financial management of the Company for the financial; year ended 30 September 2014, had failed to carry out his ‘duties as a professional accountant with due care and diligence for failure to comply with the relevant MFRS during the preparation of the financial statements of the Company’.
Mr Lim did not attend the Disciplinary Tribunal Hearing and a denial of the Complaint was entered on his behalf.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalty:
- a severe reprimand.
Mr Lim was ordered to pay CPA Australia’s costs of RM 1887.70.
