On 12 September 2018 the Disciplinary Tribunal found Mr Lindsay Wells breached Article 39(a)(ii)F of the Constitution in that he was the subject of an adverse finding that was not overturned on appeal in respect of an Order of a delegate of the Australian Securities and Investment Commission (ASIC) dated 6 February 2018, which disqualified him from being an approved SMSF auditor, effective 13 February 2018.
Mr Wells attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- a severe reprimand
- successfully complete the Ethics and Governance segment of the CPA Program or its equivalent at the time
- that Mr Wells must successfully complete the Ethics and Governance segment of the CPA Program by 31 December 2019. A failure to successfully complete the segment by the due date to result in forfeiture of Membership.
Mr Wells was ordered to pay CPA Australia’s costs of AU$597.
