On 13 June 2017 the Disciplinary Tribunal found a Member breached Article 39(a)(ii)G of the Constitution on seven occasions in respect of pleading guilty, in June 2016, before the New South Wales Local Court, to:
- five counts of breaching section 61 of the Crimes Act 1900 (NSW) (Act) – ‘assault’
- one count of breaching section 59(1) of the Act – ‘assault occasioning bodily harm’
- one count of breaching section 308H(1) of the Act – ‘unauthorised computer access’.
The Member attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the penalty of a severe reprimand on each Complaint sustained.
In arriving at the penalty that it did, the Tribunal took into account extenuating personal mitigating circumstances concerning the Member.
The Member was ordered to pay CPA Australia’s costs of $952.93.
