On 14 November 2017 the Disciplinary Tribunal found a Member breached:
Article 39(a)(ii)G of the Constitution in respect of pleading guilty, on 22 December 2016, before the Magistrates’ Court of Victoria to two counts of breaching the Crimes Act 1958 (VIC).
Article 39(a)(Ii)F of the Constitution in that on 28 June 2017 Chartered Accountants Australia and New Zealand imposed a penalty of a severe reprimand on the Member in respect of the above criminal convictions.
The Court sentenced the Member to three months jail and a Community Corrections Order until 22 March 2018.
The Member attended the Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and noted their seriousness, but taking into account extensive mitigating circumstances imposed the following penalties:
- that the Member immediately resign his Membership with CPA Australia
- the Member is not entitled to readmission to Membership until he provides proof to the satisfaction of the General Manager Professional Conduct that he is fit and proper to re-join CPA Australia
- if readmitted, it will be at CPA, not FCPA, status.
In the circumstances CPA Australia waived its costs in the matter.
