On 14 November 2017 the Disciplinary Tribunal found Mr Michael Chen breached:

• By-Law 9.5(b) in failing to successfully complete a Quality Review despite being selected in February 2016
• By-Law 5.2(b)(ii) in failing, over 18 months, to respond to CPA Australia in respect of a Complaint made about him.

Mr Chen attended the Hearing and admitted the Complaints.

Penalty and costs

The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:

• in relation to his Quality Review, forfeiture of Membership and Mr Chen is not entitled for readmission to Membership until he first:
  • successfully completes a Quality Review at his own cost as a non-member
  • has paid all outstanding fines and other monies owed to CPA Australia
• in relation to his failure to respond to Professional Conduct:
  • a severe reprimand
  • a fine of $1000.

Mr Chen was ordered to pay CPA Australia’s costs of $809.24 prior to any application for readmission.
