On 9 May 2017 the Disciplinary Tribunal found Mrs Elizabeth (Beth) Herrell breached Article 39(a)(ii)A of the Constitution in that she breached By-Law 5.2(a)(ii) in failing to respond to four Notices and seven telephone calls from Professional Conduct in response to a Complaint made about her by a client.
Mrs Herrell attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:
- forfeiture of Membership until 9 May 2019
- Mrs Herrell is not entitled to apply for a CPA Australia Public Practice Certificate until 1 January 2021
- prior to application for readmission, Mrs Herrell must first complete the Public Practice Program (or its equivalent).
In arriving at the penalty that it did, the Tribunal took into account a prior disciplinary finding against Mrs Herrell in August 2015 for identical breaches.
Mrs Herrell was ordered to pay CPA Australia’s costs of $707.04.
