On 27 September 2017 at Townsville, the Disciplinary Tribunal found Mr Daniel Forster breached Article 39(a)(ii)G of the Constitution in respect of pleading guilty, on 17 May 2017, before the District Court of Queensland to:
- one count of breaching section 228D(1) of the Criminal Code 1899 (QLD) (Code) – ‘Possessing child exploitation material’
- one count of breaching section 252(1) of the Code – ‘Possession of tainted property’.
The Court found Mr Forster was in possession of nearly 4000 images of children under sixteen.
On 18 May 2017, Mr Forster was sentenced to 18 months imprisonment wholly suspended for three years.
Mr Forster’s representative attended the Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the penalty of forfeiture of Membership and that Mr Forster is not eligible for readmission to CPA Australia.
