On 9 August 2016 the Disciplinary Tribunal found Ms Tracey Redman-Slater breached:
- Article 39(a)(ii)A of the Constitution in that she breached By-Law 5.2(b)(ii) in failing to provide requested information to Professional Conduct in response to a Complaint, within 10 Business Days, or at all
- Article 39(a)(ii)B.2) of the Constitution, in that she was guilty of conduct derogatory to or not in the best interests of CPA Australia or its Members, in undertaking to Professional Conduct to finalise a client’s work, yet failing to do so over a period of eighteen months.
Ms Redman-Slater did not attend the Disciplinary Tribunal Hearing.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties and costs:
- in relation to the failure to respond:
- a severe reprimand
- a fine of $1000
- in relation to the second Complaint:
- forfeiture of Membership.
Prior to any application for readmission to Membership, Ms Redman-Slater must first:
- provide proof that all ATO penalties and general interest charges incurred by the client have been settled or set aside
- provide proof that all documents have been returned to the client, or that she has completed winding up the client’s SMSF
- successfully complete a compliant Quality Review as a non Member at her own cost.
Ms Redman-Slater was ordered to pay CPA Australia’s costs of $634.83.
