On 31 August 2016, the Disciplinary Tribunal found Mr Simon M Birt breached Article 39(a)(ii)G of the Constitution in respect of pleading guilty in the District Court of Queensland in 2016 of one count of breaching the Criminal Code 1899 (QLD).

The Court sentenced Mr Birt to 12 months probation. No conviction was recorded.
