On 9 March 2016, the Disciplinary Tribunal found a Member breached Article39(a)(ii)E of the Constitution in that on 9 July 2015 he declared himself bankrupt.

The Member attended the Disciplinary Tribunal and admitted the Complaint.

Penalty and costs

The Disciplinary Tribunal found the Complaint sustained. The Tribunal took into account exceptional circumstances, in that the bankruptcy was largely outside of the Member’s control and imposed the penalty of suspension of Membership for the period of the Member’s bankruptcy.

The Member was also ordered to pay CPA Australia’s costs of $643.82 at the expiration of his bankruptcy and prior to reinstatement of Membership.

In light of the exceptional circumstances, the Disciplinary Tribunal ordered that the Member’s name be withheld from publication.
