On 1 December 2016 the Disciplinary Tribunal found Mr Luke D McKew breached Article 39(a)(ii)F of the Constitution in that he was the subject of an adverse finding in respect of a Decision of the Independent Liquor & Gaming Authority (ILGA) dated 13 November 2015 that he was not a fit and proper person to be a member of the governing body of a registered club, as varied by a Final Decision of the ILGA dated 30 March 2016 that Mr McKew:
- was not a fit and proper person to be a member of the governing body of the Paddington Bowling Club Pty Ltd
- be disqualified from holding office as a secretary or member of the governing body of any registered club in New South Wales for a period of two years commencing 30 March 2016.
Mr McKew attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalties and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the penalty of a severe reprimand.
The Tribunal took into account that Mr McKew had only been appointed to the Board of the Club in May 2012, until he resigned in early 2014 and had accepted the appointment to assist the Club in financial difficulties.
The Club went into receivership in June 2015.
Mr McKew was ordered to pay CPA Australia’s costs of $1305.78.
