On 25 May 2016 the Disciplinary Tribunal found Mr Arun K Kalwadia breached Article 39(a)(ii)G of the Constitution in respect of being found guilty, on 18 August 2015, in the District Court of Queensland Criminal Division, of fourteen counts of breaching section 134.1(1) of the Criminal Code Act 1995 (obtain property by deception).
Between January 2012 and May 2013, Mr Kalwadia had become involved in a scheme in which he derived a benefit approximating $105,000 from false invoices which had been created and paid upon by a government entity.
The Court sentenced Mr Kalwadia to three years jail, that he be released after five months and be of good behaviour for the balance of that term.
Mr Kalwadia attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalties and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- forfeiture of Membership for eight years (25 May 2024)
- that prior to any application for readmission, Mr Kalwadia must first:
- successfully complete the CPA Program as a non-Member, but may not enroll until after the expiration of the period of forfeiture
- have paid all outstanding membership subscriptions and costs.
Mr Kalwadia was ordered to pay CPA Australia’s costs of $698.92.
