On 25 March 2015 the Appeals Tribunal heard an appeal by Mr MD Zahidul Kabir against a determination of a Disciplinary Tribunal handed down on 4 December 2014.

The Disciplinary Tribunal found Mr Kabir breached By-Law 5.2(a) in failing to provide a sufficient and satisfactory explanation and documents in support is response to a Complaint made about him. Despite at least four letters/ emails and seven telephone calls, Mr Kabir failed to provide any response at all to Professional Conduct in relation to the Complaint made about him.

Mr Kabir attended the Appeals Tribunal Hearing.

Penalty and costs 

The Appeals Tribunal found the Complaint sustained, set aside the Determination of the Disciplinary Tribunal and imposed the following penalties:

• forfeiture of Membership and that Mr Kabir is not eligible for readmission until he provides a written explanation and documents in support to the satisfaction of the General Manager Professional Conduct of his current practice details
• a severe reprimand for failing to respond to Professional Conduct in relation to the Complaint made about him.

Mr Kabir was ordered to pay CPA Australia’s costs of $1115.23 for the Disciplinary Tribunal Hearing and $613.37 for the Appeals Tribunal Hearing.
