On 1 April 2015 the Disciplinary Tribunal found Mr Timothy Hawthorne breached Article 39(a)(ii)G of the Constitution in respect of being found guilty by the Melbourne Magistrates’ Court in October 2014 of one count of stalking.

Mr Hawthorne was convicted and sentenced to a Community Corrections Order for 24 months and 250 hours of community service.

Mr Hawthorne attended the Disciplinary Tribunal Hearing and admitted the Complaint.

Penalty and costs 

The Disciplinary Tribunal found the Complaint sustained and imposed the following penalties:

• forfeiture of Membership and Mr Hawthorne is not eligible to apply for readmission for seven years
• prior to any application for readmission and at the expiration of the seven year period of forfeiture, Mr Hawthorne must provide, to the reasonable satisfaction of CPA Australia:
  • evidence that he has not reoffended in the period prior to readmission
  • a psychiatric report that such offence is unlikely to be repeated.

Mr Hawthorne was ordered to pay costs of $604.13.
