- which was not overturned on appeal by the Administrative Appeals Tribunal in Tarrant and ASIC [2013] AATA 926 (20 December 2013), and
- in respect of which Mr Tarrant was unsuccessful on appeal to the Full Court of the Federal Court of Australia in Tarrant v ASIC [2015] FCAFC 8 (6 February 2015).
Mr Tarrant attended the Disciplinary Tribunal Hearing and admitted the Complaint.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the penalty of forfeiture of Membership for the earlier of 28 November 2018, or until such time as ASIC revokes the Banning Order.
Mr Tarrant was ordered to pay CPA Australia’s costs of $1,162.33.
