On 25 November 2015, the Disciplinary Tribunal found Mr Ricky J Tyrell breached:

• Article 39(a)(ii)B.2) of the Constitution in that he was guilty of conduct derogatory to or not in the best interests of CPA Australia or its Members
• section 4.6 of APES 310,

in that between January 2013 and April 2015, on twenty two occasions, Mr Tyrrell took a total of $65,910 from his trust account without client authority.

Penalty and costs

The Disciplinary Tribunal found the Complaints sustained.

The Disciplinary Tribunal took into account that Mr Tyrrell had repaid the monies almost immediately and imposed the following penalties:

• forfeiture of Membership for three years
• prior to any application for readmission, Mr Tyrrell must first complete the Practice Management Program, including the distance learning and residential components.

Mr Tyrrell was also ordered to pay CPA Australia’s cost of $777.65.
