On 25 March 2015 the Disciplinary Tribunal found Mr Mark L O’Neil breached Article 39(a)(ii)F of the Constitution in that he was the subject of an ‘adverse finding’ in respect of a Decision of the Australian Securities and Investment Commission dated 29 October 2013 that he be disqualified from managing corporations for one year effective 29 October 2013, which Decision was affirmed upon review by the Administrative Appeals Tribunal on 27 June 2014.
Mr O’Neil was involved in the management of four corporations within the Beacon IT Group of companies, which were all placed into administration around 2010 and 2011 owing substantial liabilities to the ATO, former employees and unsecured creditors.
Penalty and costs
The Disciplinary Tribunal imposed the following penalties:
- a severe reprimand
- that Mr O’Neil successfully complete the Ethics & Governance segment of the CPA Program by 30 June 2016, a failure to do so to result in forfeiture of Membership until completed.
Mr O’Neil was ordered to pay costs of $684.04.
