On 21 October 2015, the Disciplinary Tribunal found Mr (James) Stephen Lewis breached Article 39(a)(ii)G of the Constitution in respect of being found guilty in the County Court of Victoria on 6 September 2013 of one count of breaching section 1308(2) of the Corporations Act 2001, which was not overturned on appeal by the Victorian Supreme Court of Appeal in Lewis v The Queen [2014] VSCA 188.

Mr Lewis was sentenced to a wholly suspended sentence of 12 months imprisonment.

Mr Lewis attended the Disciplinary Tribunal Hearing and admitted the Complaint.

Penalty and costs

The Disciplinary Tribunal found the Complaint sustained and imposed the penalty of suspension of Mr Lewis’ Membership for 12 months from the date of the Hearing.

Mr Lewis was ordered to pay costs of $519.20.
