- Article 39(a)(ii)I of the Constitution in failing to provide a written explanation and documents in support in relation to a Complaint made about him concerning his Quality Review.
Mr Bain did not attend the Disciplinary Tribunal Hearing.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- in relation to his failure to complete his Quality Review, forfeiture of Membership and that Mr Bain is not eligible for readmission until he:
- first successfully completes a compliant Quality Review as a non Member at his cost
- has paid all outstanding monies owed to CPA Australia including Membership subscriptions, costs of this Hearing and fines
- in relation to his failure to respond, a severe reprimand.
The Disciplinary Tribunal further determined Mr Bain must remove all references to CPA Australia’s intellectual property by 30 0ctober 2015, a failure to do so to result in a fine of $1000
Mr Bain was ordered to pay CPA Australia’s costs of $811.07.
