On 27 August 2015, the Disciplinary Tribunal found Mrs Elizabeth (Beth) Herrell breached:

• Article 39(a)(ii)A of the Constitution in that she breached By-Law 5.2(a)(ii), and
• Article 39(a)(ii)I of the Constitution,

in failing to respond to three Notices and four telephone calls from Professional Conduct in response to a Complaint made about her.

Mrs Herrell attended the Disciplinary Tribunal Hearing and admitted the Complaints.

Penalty and costs 

The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:

• a severe reprimand
• within 10 business days from the date of the Hearing, she provide to the satisfaction of the General Manager Professional Conduct, a written explanation in response to the issues raised in the Complaint and any relevant documents, a failure to comply to result in forfeiture of Membership until satisfied
• a fine of $1,000 payable by 30 November 2015, a failure to pay by the due date to result in forfeiture of Membership.

Mrs Herrell was ordered to pay CPA Australia’s costs of $771.18.
